Opposition MP takes legal action against Dewan Rakyat speaker, secretary over rejected 1MDB questions

KUALA LUMPUR: Petaling Jaya Selatan MP Hee Loy Sian has initiated a legal action against Dewan Rakyat secretary and speaker after his questions on 1Malaysia Development Berhad (1MDB) were rejected in Parliament.
Hee, 47, had through his lawyers, filed an originating summons at the High Court registrar today naming Datuk Roosme Hamzah and Tan Sri Pandikar Amin Mulia as the first and second defendants.
He is seeking a declaration that Roosme and Pandikar's action in rejecting the questions was unconstitutional and void.
The PKR MP claimed that on July 7, he had sent an email to the first defendant of 10 questions to be answered by the relevant ministers in Parliament.
However, he was informed that the defendants had rejected two of his questions relating to 1MDB scandal and on Malaysian businessman Jho Low through two letters dated July 21.
N. Surendran, who represented Hee, said the lawsuit was filed as the speaker had breached the constitution by rejecting the questions.
"If we can't ask questions then it means that Parliament is not functioning properly and we have no choice but to invoke the constitution and seek the aid of the courts to ensure that it is adhered," he said.
He added that this is a test case and the outcome of this legal action will bind to other cases related to it.
